General Terms and Conditions (GTC) Peak Moments Deisenberger Ski & Racing School

§ 1 Scope of Application
These General Terms and Conditions apply to all contracts between Ski & Rennschule Deisenberger and its customers regarding the provision of ski courses and race training. Terms and conditions of the participant that differ from these shall not be recognized unless the school expressly agrees to their applicability in writing.
§ 2 Conclusion of Contract and Registration
Registration for a course or race training session is made in writing (via email or online form) and constitutes a binding offer by the participant. The contract is concluded upon the school's written booking confirmation. When registering a minor, the signature of a legal guardian is required. By registering, the legal guardian confirms having acknowledged these General Terms and Conditions and agrees to their applicability.
§ 3 Scope of Services
3.1 Ski Courses
The school offers ski courses for various skill levels (beginners, intermediate, experts). The specific content, duration, and maximum number of participants are specified in the respective course description.
3.2 Race Training
The race training program covers ski instruction with a focus on racing technique, gate skiing, and race tactics. Participation requires a sufficient level of basic skiing proficiency, as determined by the school.
3.3 Not included in the scope of services
Unless expressly agreed otherwise, the following services are not included in the course price:

Ski pass fees and lift tickets

Ski equipment
-
and protective gear (helmet, back protector, etc.)

Transport and accommodation
-
Meals Racing licenses and entry fees
§ 4 Prices and Terms of Payment
Current course fees can be found in the school's latest price list. All prices are quoted in euros (EUR) and include statutory VAT. Following booking confirmation, a deposit of 30% of the course fee is due within 7 days. The remaining balance must be paid no later than 14 days before the course begins. For bookings made less than 14 days before the start of the course, the full course fee is due immediately. If the amount due is not paid within the specified timeframe, the school reserves the right to withdraw from the contract.
§ 5 Cancellation Terms and Withdrawal
5.1 Withdrawal by the participant
Cancellation of a camp:
Participants may withdraw from the contract at any time. In the event of withdrawal, the following cancellation fees apply:

More than 14 days before the start of the course: free cancellation.

14 to 7 days before the start of the course: 50% of the course fee is refunded as a credit.

6 to 4 days before the start of the course: 25% of the course fee is refunded as a credit.

Less than 3 days before the start of the course or in the event of a no-show: no refund or credit; the participant bears 100% of the costs. Withdrawal must be submitted to the school in writing (via email). The time of receipt of the notification by the school is decisive.
Cancellation of private lessons (ski school and race school)

Participants may withdraw from the contract up to 5:00 p.m. on the day prior. In this case, a 20% cancellation fee will be charged. In the event of a later cancellation or a no-show, the full fee (100%) is payable.
Withdrawal must be submitted to the school in writing (via email). The time at which the school receives the notification is decisive.
5.2 Withdrawal by the school
The school is entitled to withdraw from the contract if:

the minimum number of participants is not reached (withdrawal no later than 7 days before the start of the course),
-
force majeure or extraordinary circumstances (e.g. extreme weather conditions, closure of the slopes) make implementation impossible,
-
the participant does not have the skills required for the respective course. In the event of cancellation by the school, payments already made will be fully refunded. Further claims for damages by the participant are excluded unless the school acted intentionally or with gross negligencet.
§ 6 Course Cancellations and Program Changes
The school reserves the right to reschedule courses or appropriately adjust the program content due to adverse weather conditions, insufficient snow cover, closed slopes, or safety reasons. In such cases, the school will offer an alternative date. If an alternative date is not possible or is unreasonable for the participant, the pro-rata course fee will be refunded.
§ 7 Obligations and Conduct of Participants
Participants are required to:

arrive punctually at the agreed meeting point,
-
follow the instructions of the ski and race instructors at all times,
-
comply with FIS rules for skiers as well as local slope regulations,
-
wear a ski helmet (mandatory by law for children under 15 pursuant to § 68a of the Road Traffic Regulations [STVO];
-
strongly recommended for all participants), ensure they wear a back protector during race training and appropriate protective gear (e.g., shin guards, gloves with protectors) during slalom runs,
-
be physically and technically capable of meeting the demands of the booked course. Participants who violate these obligations or jeopardize the conduct of the course may be excluded from instruction without a refund of the course fee.
§ 8 Liability
Skiing, and race training in particular, entail an increased risk of accidents. Participants take part in the courses at their own risk. The school is liable for damages caused by its staff through willful misconduct or gross negligence. In cases of ordinary negligence, the school is liable only for the breach of essential contractual obligations (cardinal obligations), and even then, only up to the amount of typically foreseeable damage. Liability for personal injury or property damage arising from the inherent risks of skiing and racing—and not attributable to any culpable act by the school—is excluded. The school assumes no liability for equipment or personal belongings brought by participants. The foregoing limitations of liability do not apply to damages resulting from injury to life, body, or health, nor to claims under the Austrian Product Liability Act (PHG).
§ 9 Insurance
The school strongly recommends that all participants take out private accident and liability insurance. The school is not liable for damages resulting from the participant's lack of suitable insurance.
§ 10 Data Protection
The school processes participants' personal data exclusively for the purpose of contract fulfillment and in accordance with applicable data protection regulations (specifically the GDPR and the DSG). Please refer to our privacy policy, available on our website, for further details.
§ 11 Photographs and Video Recordings
During the course, photos and videos may be taken for instructional purposes and to document the race training. Any recordings beyond this scope intended for promotional purposes will only be made with the express written consent of the participant or, in the case of minors, their legal guardian.
§ 12 Severability Clause
Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected thereby. In place of the invalid provision, a valid provision shall be deemed agreed upon that comes as close as possible to the economic purpose of the invalid provision.
§ 13 Applicable Law and Place of Jurisdiction
Austrian law applies exclusively, excluding the UN Sales Convention (CISG). For consumers within the meaning of the Consumer Protection Act (KSchG), the statutory places of jurisdiction apply. For disputes with business entities, the school's registered office is agreed upon as the place of jurisdiction.
